Car Hire Agreement

  • I am not under 23 years or over 70 years of age.

  • I do not suffer from any physical deformity, defective vision, or defective hearing that may impair driving ability.

  • I have not been convicted in the past 5 years for careless, reckless, or dangerous driving.

  • I have held a valid driving license for at least 2 years, currently free from endorsement.

  • No insurer has ever:

      • Declined my proposal,

      • Required increased premiums,

      • Imposed special conditions,

      • Refused to renew, or

      • Canceled my motor insurance policy.

  • The motor vehicle will not be used for:

    • Carriage of passengers for hire or reward.

    • Carrying more passengers than declared.

  • The vehicle is for local use only and shall not be taken outside Kenya.

  • My driving license has been examined by P.A.A. Car Hire and Safaris.

  • All cars are insured, subject to an excess of Kshs. 75,000 per claim.

  • Windscreens are not covered and remain the responsibility of the hirer.

  • In case of theft while in my custody, I will pay the excess premium of Kshs. 75,000.

  • Any accident must be reported to the owner within 48 hours, and to police and other authorities as required by law.

  • In case of accident, the hirer shall provide full cooperation, including statements, drawings, and necessary information.

  • In addition, a non-refundable excess fee of Ksh. 50,000 and loss of business applies per accident (excluding towing charges).

  • Full payment of hire is required before departure.

  • If the vehicle is returned late, Ksh. 500 per hour will be charged.

  • If the hirer cancels after payment, no refunds shall be issued.

  • A minimum of 100 km per day will be charged.

  • Speedometer tampering is prohibited; violations attract legal action and/or a charge of 500 km per day.

  • The hirer must check oil and water levels regularly; damages due to neglect are payable by the hirer.

  • The hirer may not give the car to another person without prior consent from the company.

  • Any repairs must be reported and authorized by the company before being undertaken.

  • The hire period must be specified in the contract.

  • Keeping the car beyond the agreed period without authorization is an offence and may lead to police notification.

  • The company reserves the right to repossess the vehicle or report it stolen if not returned on time.

  • All recovery and legal costs will be charged to the hirer.

  • I declare that the above statements are true to the best of my knowledge.

  • I understand that these declarations form part of the insurance and hire agreement.

  • I accept all conditions stated herein.
